PRIVACY POLICY

1. Data Controller
This privacy policy applies to the processing of data by Haus am Fluss AG, Limmatquai 40, Zurich, Switzerland (hereinafter referred to as “Haus am Fluss”).

2. Collection and storage of personal data as well as the type and purpose of their use when visiting our website
When you access our website www.haus-am-fluss.ch, the browser used on your end device automatically sends information to our website server. This information is temporarily stored in a so-called log file. The following information is collected without your involvement and stored until automatically deleted: 
IP address of the requesting computer, 
date and time of access, 
name and URL of the retrieved file, 
website from which access is made (referrer URL). 
We process the data mentioned for the following purposes: 
ensuring a smooth connection to the website, 
ensuring convenient use of our website, 
evaluating system security and stability, and 
for other administrative purposes. 

Within the scope of the European General Data Protection Regulation, the legal basis for data processing is Article 6(1)(f) GDPR. Our legitimate interest follows from the data collection purposes listed above. Under no circumstances do we use the collected data for the purpose of drawing conclusions about your person. 
In addition, when you visit our website, we use cookies and analytics services. Further explanations can be found under the following sections of this privacy policy. 

For the data you provide to us when using our “Newsletter” form, we ask you to provide your name, email address, telephone number and other information. We use this data solely to process your request and to provide the services you have requested. We store this data for as long as necessary for providing information or delivering our services, unless a longer retention period is in our legitimate interests or is required by law. More detailed information about the “Newsletter” form can be found in the associated guidelines. 

3. Cookies
We use cookies on our website. These are small files that your browser automatically creates and that are stored on your end device (laptop, tablet, smartphone, etc.) when you visit our site. 
The cookie stores information that is associated with the specific end device used. However, this does not mean that we obtain direct knowledge of your identity. 
On the one hand, cookies are used to make using our services more convenient for you. We use so-called session cookies to recognize that you have already visited individual pages of our website. These are automatically deleted after you leave our site. 
In addition, we also use temporary cookies to improve user-friendliness, which are stored on your end device for a specified period. Most browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or so that a notice always appears before a new cookie is created. Completely disabling cookies may, however, mean that you cannot use all functions of our website. 

4. Google Analytics
We use tracking tools to ensure that our website is designed to meet requirements and is continuously optimized. In addition, we use the tracking measures to statistically record the use of our website and evaluate it for the purpose of optimizing our services for you. These interests are considered legitimate within the meaning of the aforementioned provision. Within the scope of the GDPR, the tracking measures listed below and used by us are carried out on the basis of Article 6(1)(f) GDPR. 
The respective data processing purposes and data categories can be found in the explanations below for the corresponding tracking tools. 
For the purpose of tailoring and continuously optimizing our pages to meet requirements, we use Google Analytics, a web analytics service of Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter referred to as “Google”). In this context, pseudonymized usage profiles are created and cookies (see under section 4) are used. The information generated by the cookie about your use of this website, such as 
browser type/version, operating system used, referrer URL (the previously visited page), host name of the accessing computer (IP address), time of the server request, is transmitted to a Google server in the USA and stored there. The information is used to evaluate website use, to compile reports on website activities and to provide other services related to website and internet use for market research and tailored design of these web pages. This information may also be transferred to third parties if required by law or if third parties process this data on our behalf. Under no circumstances will your IP address be merged with other Google data. IP addresses are anonymized so that assignment is not possible (IP masking).

Your data will be disclosed to third parties if: you have given your express consent (within the scope of the GDPR, the legal basis in this case is Article 6(1)(a)), disclosure is necessary for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data (within the scope of the GDPR, the legal basis in this case is Article 6(1)(f)), if there is a legal obligation for disclosure (within the scope of the GDPR, the legal basis in this case is Article 6(1)(c) GDPR), and this is legally permissible and necessary for the handling of contractual relationships with you (within the scope of the GDPR, the legal basis in this case is Article 6(1)(b) GDPR). 

6. Your rights
You have the right to request information about your personal data processed by us. In particular, you may request information about the purposes of processing, the categories of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data, provided they were not collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about its details; to request without delay the rectification of inaccurate or completion of your personal data stored by us; to request the erasure of your personal data stored by us, insofar as processing is not necessary for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims; to request the restriction of processing of your personal data insofar as the accuracy of the data is contested by you, the processing is unlawful, but you oppose its erasure and we no longer need the data, but you need them for the assertion, exercise or defence of legal claims, or you have objected to the processing; 

Within the scope of the GDPR, you also have the right to receive your personal data provided to us in a structured, commonly used and machine-readable format or to request the transfer to another controller (Article 20 GDPR); if our data processing is based on your consent, you have the right to withdraw your consent at any time. This means that we may no longer continue the data processing based on that consent in the future; to lodge a complaint with a supervisory authority. 

7. Objection
Within the scope of the GDPR, you also have the right to object to the processing of your personal data, insofar as your personal data are processed on the basis of legitimate interests pursuant to Article 6(1)(f) GDPR and there are reasons arising from your particular situation or the objection is directed against direct marketing. In the latter case, you have a general right to object, which we will implement without requiring a particular situation.

8. Retention periods 
We store your data no longer than necessary for the purpose for which it was collected. This is determined on a case-by-case basis and depends, among other things, on the type of data provided, the reason for its collection, the legal basis on which we rely for processing the data, and our respective legal or operational retention obligations. 

9. Children
Our websites and other services are not directed at children. We do not aim to collect or knowingly collect, or otherwise process, information from persons under 13 years of age. 
If you are under 13 years old, we ask you not to provide us with your data and not to use our websites. If you are a parent or guardian of a child under 13, please contact us if you know that your child has used our websites or has otherwise provided us with their data without your consent. We will delete or otherwise cease processing your child's personal data. 
If you are 13, 14 or 15 years old, we ask you to obtain the permission of your parents or legal guardians before providing us with your information or using our websites. 

10. Data security
During your visit to our website, we use the widely used SSL procedure (Secure Socket Layer) in conjunction with the highest level of encryption supported by your browser. As a rule, this is 256-bit encryption. If your browser does not support 256-bit encryption, we instead use 128-bit v3 technology. You can tell whether a single page of our website is transmitted in encrypted form by the closed display of the key or lock symbol in the lower status bar of your browser. 
We also use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continually improved in line with technological developments. 

11. Validity of this privacy policy 
This privacy policy is currently valid and was last updated in June 2023. 
Due to the further development of our website and offers about it or due to changed legal or official requirements, it may become necessary to amend this privacy policy. The current privacy policy can be accessed and printed by you at any time on the website at https://www.haus-am-fluss.ch/de /datenschutz. 

12. Online table reservation
If you make a table reservation via our website and our partner portal “Aleno”, your email address provided will automatically be included in the next newsletter mailing. If you no longer wish to receive news from us in the future, you can remove yourself from the mailing list independently. Otherwise, you can also write to us at info@haus-am-fluss.ch to unsubscribe.
